Porn vs Prostitution: The reality behind the joke.

Recommended Posts

For over a decade a heard this joke: "The difference between porn and prostitution? The camera." As a joke, it's kinda funny. As a legal advice it's pretty bad.

More than once I had discussions with men who seriously believed a camera could get them off the hook if busted, and  had to explain everything wrong with it:

Without going into the legal intricacies, prostitution is the practice or occupation of engaging in sexual activity with someone for payment. In other words money for services.

Making a porno is completely different as it's a movie production. No matter if made on a large or minimalistic budget, you got actors, actresses, a director, editor, producer, distributor and all is on paper with contracts and everyone gets paid.

And in cases where women perform double duty as porn actresses and providers, they fall under local prostitution laws when they offer services outside of a movie production. She can maybe try to give producer credit to a busted client, but I highly doubt it would fly in front of a judge.

  Any other opinions about this?
