Logic of SCC ruling re Insite applicable to Bedford? ... I hope so!

Also, the decision in the Bedford case will be coming down within the next two months or so. Should prove interesting...

Perhaps I was mistaken about the two month time frame regarding a decision in this case. Does anyone have an update and/or additional information on when we can expect some movement from the court of appeal?

The Ontario Court of Appeal could be publishing its ruling any time now. There is no firm time frame. As far as I know, the Court only provides one business day's advance notice of the pending release of their decisions.

Jumping ahead a little... let's say for argument's sake that eventually, the Bedford case goes before the Supreme Court and Himmel's original decision is upheld. Then, for all intents and purposes the adult entertainment industry has won. However, in such a scenario, would it not give parliament carte blanche to draft new laws in the spirit of the Nordic model? We would then be worse off than we are now.

Parliament at any and all times has the authority and right to pass legislation.

 

Exactly what constraints the current constitutional challenge may or may not ultimately place upon the content of any future prostitution law in Canada will be determined by the specific findings and logic of the higher court decisions. These rulings, as we know, are not yet issued.
