Halifax police charged a man, woman and an underage female with prostitution-related offences early Thursday morning.

 

A 20-year-old Truro woman was charged with keeping a common bawdy house after the Halifax Regional Police/RCMP integrated vice unit searched a residence in the 1900 block of Brunswick Street at 1:44 a.m.

 

Two others ? a 20-year-old male from Dartmouth and a 16-year-old female from Truro ? face a charge of being an inmate of a common bawdy house.

 

All three have been ordered to appear in court at a later date. They have been released, but are not allowed to return to the building, according to regional police spokesman Const. Brian Palmeter.

 

?In effect we?ve shut it down,? he said, adding that police searched the residence after taking a call from the public Wednesday afternoon.

 

?It was basically a public complaint about suspicious or potentially illegal activity taking place.?

 

He said none of the three are related and police did not contact the Department of Community Services about the 16-year-old.

 

When asked what the charge of being an inmate of a bawdy house means, he said, ?It is an offence to be a resident or a regular occupant of a common bawdy house. It doesn?t necessarily mean they were engaged in it (prostitution). They had to have known this criminal behaviour was taking place.?

 

In late September, the Ontario Superior Court struck down Canada?s prostitution laws in a ruling that said they were unconstitutional and put sex-trade workers in danger.

 

The federal and Ontario governments, however, have said they will appeal that decision. Other provinces have said they would continue to enforce the existing laws for the time being. Vancouver police laid bawdy house charges a little more than a week after the Ontario decision.

 

Palmeter said their position hasn?t changed.

 

?We?re going to continue on conducting business as usual.?

 

Rene Ross, executive director of the local sex-worker support group Stepping Stone, said the existing laws force sex workers to work on the streets, although they?d feel safer working indoors. She?s been a vocal opponent of Canada?s prostitution laws for some time and recently spoke out on that issue after the highly publicized killing of one Halifax sex worker and attacks against two others.

 

She?s very concerned that police laid charges against the 16-year-old, who is too young to be a Stepping Stone client.

 

For starters, she said the inmate charge is very vague.

 

?The law is so scattered that we don?t know what this means.?

 

Ross said the 16-year-old might have been engaged in sexual activity or might have simply been in the residence. Either way, that girl has now been thrown into the justice system, Ross said.

 

?That is going to do absolutely nothing to support these youth that are being exposed to this very dangerous trade. It?s just going to put that youth in more danger.?

When someone rents a hotel room, does it become their residence in the eyes of the law? It confuses me as to how a hotel room could become a residence, thus a bawdy house.

According to Section 197 of the Criminal Code, a " 'common bawdy-house' means a place that is (a) kept or occupied, or (b) resorted to by one or more persons for the purpose of prostitution or the practice of acts of indecency ..." and also a " 'place' includes any place, whether or not (a) it is covered or enclosed, (b) it is used permanently or temporarily, or © any person has an exclusive right of user with respect to it ..."

 

So whether a place happens to be a residence or a hotel room (or whatever else) is irrelevant to whether or not it is a bawdy house. The police termed this a "residence", in their press release, without stating the exact location. CTV News independantly found out where it was, and this was confirmed by the hotel manager.

If you (the customer) rents a room and you invite the lady to the room then it is not considered a common place of prostitution...but if she rents the room and takes multiple calls to that room... it can be considered a common bawdy house.

Please don't speculate on who this is. Whenever I see these threads they give me great concern because reputations are at stake. These news items should be shared with the board so we can be reminded of issues and current events that affect us, but they should not become a "gossip gab" for trying to figure out who is involved.

Seems as though we have lost sight of the big picture here since, as redmachine points out, there was a 16yr old present! Perhaps we should all be more concerned about the presence of a minor as opposed to finding out who the lady or ladies are! Excellent point redmachine thank you for providing perspective.

I agree..I'm glad the hear that this 16 y/o has been removed from what was possibly a dangerous situation for her ( just speculating).

 

When I hear of young girls like this "working" or even just being in the environment it makes me sick.....someone has obviously exploited this poor young girl....

 

 

NOTE: regarding my other comment..all I was saying is that HOW DARE ONLYHOTTIES123 post that the girls arrested where "so and so" when he is just speculating, just ignorance I guess...

CL is the furthest thing from a credible source once can get! Here we like first hand information (Not rumor or hearsay). If you have some first hand info that you wish to bring to light post it but reading something on CL as fact is foolish... in fact anything you find on CL you should always approach with caution.

Point well taken. The timing and information is certainly coincidental. The day before the charges hit the news, the CL post is made, connecting the two DF's as the same. The pattern is also the same - both DF's allegedly employing underage girls. I admit this is where I am basing my speculation and I have never claimed it as fact. If there is any reason my post should be modified or deleted, I fully understand.

Well Mr. Mod, you got your early Christmas present. CL erotic section is no more. We are well aware of your stance on CL. CERB will generate more revenue through ads because there will be an increase in site traffic. A Halifax man allegedly forced a 17-year-old girl to become a prostitute and then threatened to kill her if she quit working for him.

 

Darrell Robert William Fisher, 22, was arraigned in Halifax provincial court Wednesday on charges of living off the avails of a person under the age of 18, compelling a person to engage in prostitution, keeping a common bawdy house, assault and uttering threats.

 

Judge Bill Digby scheduled a bail hearing for Friday and remanded Fisher to the Central Nova Scotia Correctional Facility in Dartmouth.

 

Crown attorney Darrell Martin said he was opposed to Fisher’s release.

 

The alleged victim’s identity is protected by a court order. Halifax Regional Police checked up on her at her home last Friday at the urging of a friend, who was worried that the girl was being abused by her pimp but was too scared to get out of the business.

 

The girl agreed to go to the police station, where she gave officers a statement about her past six months with Fisher.

 

She said Fisher talked her into becoming a prostitute in June and that she had as many as 300 clients a month. The sexual activity usually took place at Fisher’s residence on North Street, she said, but sometimes he would drive her to appointments at local hotels.

 

Fisher made her do whatever the johns wanted, she said, including having intercourse without a condom. If she was reluctant to comply with their wishes, he would assault or threaten her, she alleged.

 

The girl told police that Fisher took most of the money she made — an estimated $3,000 a week.

 

The teenager said that when she tried to leave, the pimp would drive her to Peggys Cove and threaten to throw her into the ocean. She alleged that Fisher used similar tactics to control three other teens.

 

Based on the girl’s statement, members of the regional police-RCMP integrated vice unit got a warrant to search Fisher’s home Saturday. Officers seized a computer and other items.

 

Fisher was arrested Tuesday after he turned himself in at police headquarters.

 

In court Wednesday, the judge ordered Fisher to have no further contact with the girl.

 

Const. Brian Palmeter, spokesman for regional police, said the girl did not require hospital treatment but has been through significant trauma.

 

"We will provide any resources we can to assist her throughout this ordeal," he said.

 

Palmeter said if additional information comes in that links Fisher to any other alleged victims, investigators will "take action."

 

"If there are other complainants, we would urge them to come forward," he said.

Two people appeared in Halifax provincial court Tuesday on prostitution-related charges stemming from a police raid at a downtown hotel last month.

 

Marissa Marie MacDonald, 20, of Willow Lane in Truro was arraigned on a charge of keeping a common bawdy house.

 

Kane Russell Gabriel, also 20, of Rosedale Drive in Dartmouth faces a charge of being in a bawdy house without lawful excuse.

 

The pair were arrested in the early morning hours of Nov. 4 after officers with the Halifax Regional Police-RCMP integrated vice unit, acting on a tip from a member of the public the day before, searched a room at the Citadel Halifax Hotel on Brunswick Street.

 

A 16-year-old girl from Truro allegedly found in the room was also charged with being in a bawdy house. She's being dealt with in Halifax youth court.

 

MacDonald and Gabriel are both in the process of retaining legal counsel, so Judge Bill Digby agreed to adjourn their cases until Feb. 2.

 

Keeping a bawdy house is an indictable offence punishable by a jail term of up to two years. Being in a bawdy house is a summary matter, with a maximum penalty of six months in jail and a $5,000 fine.
